Dismissal via a termination or settlement agreement

In many employment termination cases the employer makes a proposal for the ending of the  employment contract. This often takes the form of a draft agreement setting out all the terms proposed by the employer for the employment termination which the employer desires. It is important that you do not just sign this agreement, but that you first obtain the advice of an Advocate specialising in employment termination. Because the question is whether the termination of employment that the employer desires is actually correct. Besides this, experience  has taught us that in nearly all cases a (much) better arrangement can be obtained – including for example a higher level of compensation for termination of employment – than the proposal  made by your employer.
